Terms of Service — MightyIdea

1. Agreement

These Terms of Service (the “Terms”) govern your access to and use of mightyidea.com (the “Site”), operated by MightyIdea LLC (“MightyIdea”, “we”, “us”). By accessing the Site you agree to these Terms. If you do not agree, do not use the Site.

Our Privacy Policy describes how we handle personal information and is incorporated into these Terms by reference.

2. Use of the Site

The Site is provided for general informational purposes. You may view and share its content for lawful, personal, or internal business purposes.

You agree not to use the Site to break any law; to attempt to gain unauthorised access to it or to any related system; to interfere with its normal operation, including by automated scraping that imposes an unreasonable load; or to reproduce, republish, or resell its content for commercial purposes without our written permission.

3. Intellectual property

The Site and its contents, including text, layout, design, code, and graphics, are owned by MightyIdea or its licensors and are protected by intellectual property law. MightyIdea™ and the MightyIdea logo are trademarks of MightyIdea LLC. Except for the limited use permitted in section 2, no right or licence is granted to you.

Third-party names and marks appearing on the Site, including those of platforms with which our projects are compatible, remain the property of their respective owners and are used for identification only.

4. No offer and no professional relationship

Information on the Site, including project listings and their status labels, is provided for information only and does not constitute an offer, a solicitation of an offer, a price quotation, or a binding commitment of any kind. This includes any domain name described as available for sale, which may be withdrawn, sold, or repriced at any time without notice.

Contacting us, whether through the contact form or by email, does not create a client, agency, or other professional relationship. No such relationship arises until a written agreement is signed by both parties.

5. Enquiries and submissions

Please do not send confidential or proprietary information through the contact form or in unsolicited email. Material sent to us that way is received on a non-confidential basis, and we accept no obligation of confidentiality in respect of it beyond the protections described in our Privacy Policy.

If you would like to discuss something in confidence, tell us and we will put a non-disclosure agreement in place first. Information shared under a signed non-disclosure or engagement agreement is governed by that agreement, and nothing in this section limits it.

We work with clients across a range of sectors. We may already be working on, or may in future work on, projects in the same subject matter as an enquiry, and nothing in an enquiry restricts the work we are free to accept. We are under no obligation to respond to or act on any enquiry, and you grant us no rights in your submission beyond those needed to read it and reply.

6. Third-party sites

The Site links to sites we do not control. We provide those links for convenience, do not endorse their content, and are not responsible for them. Your use of a third-party site is governed by that site’s own terms.

7. Availability

We may change, suspend, or discontinue the Site or any part of it at any time and without notice. We do not warrant that the Site will be available uninterrupted or error-free.

8. Disclaimer of warranties

The Site is provided “as is” and “as available”, without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the Site’s content is accurate, complete, or current.

9. Limitation of liability

To the fullest extent permitted by law, MightyIdea will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or relating to your use of the Site, whether based in contract, tort, or any other theory, and whether or not we have been advised of the possibility of such damages. Our total liability arising out of or relating to the Site will not exceed one hundred United States dollars (US$100).

Some jurisdictions do not allow certain exclusions or limitations of liability, so parts of this section may not apply to you.

10. Governing law

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Salt Lake County, Utah for any dispute arising out of or relating to these Terms or the Site.

11. General

If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will stay in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site.

12. Changes and contact
